The terms behind every birkhub order.

These conditions govern the sale of products on this website. They sit alongside our Terms of Service and explain ordering, pricing, delivery, payment, returns, and warranties.

Purpose & Scope

These Terms of Sale apply to every purchase made on the birkhub website by a customer (“you”). By placing an order, you accept these terms in full. birkhub sells products to consumers for personal use, and orders that appear to be intended for resale may be declined.

Products

We sell clogs, sandals, and footwear products described on their respective product pages. We strive to present product information, sizing guidance, images, and specifications as accurately as possible.

Minor differences in color, texture, or finish may occur due to screen settings and manufacturing variations. All products are subject to availability. If an item becomes unavailable after an order is placed, we will offer an alternative product or a full refund.

Placing an Order

Your order represents an offer to purchase products from birkhub. A binding sales contract is formed only when we send an order confirmation email.

Payment

Accepted payment methods, billing procedures, and payment security details are described in our Payment Policy.

Payments are processed through encrypted PCI-DSS compliant payment providers. birkhub does not store complete payment card numbers.

Orders are charged when confirmed. The total shown during checkout represents the complete amount payable, with no hidden fees.

Delivery

We currently ship within the United States only. All orders are dispatched from our Austin, Texas warehouse and include free shipping.

Delivery estimates are provided in good faith but cannot be guaranteed because transportation is performed by third-party carriers. If a package is confirmed lost or arrives damaged, we will provide a replacement or a full refund.

Returns & Cancellation

Customers may return eligible products within 30 days of delivery for any reason.

Returned products should be unworn outdoors and, where reasonably possible, returned with original packaging. Full return procedures are available in our Return & Refund Policy.

Conformity & Warranty

We warrant that products will substantially match their descriptions and be free from manufacturing defects under normal intended use.

If you receive an incorrect or defective product, contact us promptly and we will arrange either a free replacement or a full refund. These rights exist in addition to any mandatory consumer rights available under applicable law.

Liability

To the fullest extent permitted by law, birkhub’s liability relating to any product or order is limited to the amount paid for that order.

We are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, natural disasters, transportation disruptions, labor disputes, government actions, or other force majeure events. Where appropriate, we will provide updates and offer refunds if fulfilment becomes impossible.

Governing Law & Disputes

These Terms of Sale are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.

The state and federal courts located in Travis County, Texas shall have exclusive jurisdiction over disputes not resolved directly between the parties. We encourage customers to contact us first so issues can be resolved quickly and amicably.
